How Does Chapter 7 Bankruptcy Work?

In a Chapter 7 bankruptcy, debts are discharged in exchange for the sale or liquidation of some of your assets. Some debt obligations, such as student loans, child support and certain taxes, may not be eliminated through Chapter 7 bankruptcy. At the same time, certain assets, including your principal residence and vehicle, are usually exempt from sale in a Chapter 7.

Simply filing for Chapter 7 will put an automatic stay into effect, ending harassing calls from creditors while we work out the final details of your bankruptcy.

Personal Attention to Your Specific Needs

Throughout over 25 years of bankruptcy representation, I have learned that no two financial situations are alike. Your specific needs are unlike somebody else's needs — I am a lawyer that does not believe in cookie cutter solutions.

To provide the best possible service, I work closely with you to determine your Chapter 7 eligibility. The law may push individuals toward Chapter 13 bankruptcy if income exceeds the thresholds established by the means test. With all my clients, however, I take the time to evaluate the ways in which you might still qualify even if you exceed the median, through careful analysis of your options. If you qualify for Chapter 7, I work to help you understand which debts can be discharged and ensure that all exempt property is excluded.
